I can't answer because the cable is connected to the NIU through a fancy block type connector, and on the other end there is an RJ45 crimped to it. This goes directly into the Switch.

I have tested by plugging the MD110 and the server into a decated isolated switch, the same problem occurs, I don't think this is a network related issue. even if I just connect the MD110 by itself to the switch I get a link status (Link LED is on) but no activity (Activity LED off)

I have managed to restart the NIU, however I get a short burst of between one and three ping replies. Having a good solid networking background I assume there is a service/setting which is conflicting causing the NIU not to work.

There must be some corruption here of some sort because in the
extention manager there is reference to BC12, I will quickly see if I can find where I saw that and get back to you.
