Spoke too soon. Not exactly fixed so much as still have the same problem we stared with. The only way it works is if we do not back up the system state. I was told it was working fine and it isn't actually working since we can't back up everything including the system state.

okay the problem is fixed. we just started doing the backup in small parts and found the file it was dying on and repackaged the job and now it is okay. It is yet to be determined why ArcServe crached on that file.
