Upgrade with new 500v2 instead of an Upgrade License

We have a customer that is on 8.0 today and they already have a 500v2 but it is dead. They have purchased a new 500v2 chassi that is on 9.0 and are wondering if they can follow the below process without needing an upgrade license.

Back up configuration, recreate existing SD card from 8.0 to 9.0, then plug all cards and SD card into the new 500v2 that is already on 9.0. Is this a way around needing an upgrade license? Or will the SD card know its been upgrading without the required license?

I guess we are unsure as to what piece of equipment realizes an upgrade has occurred? Is it the 500v2 or the SD card?
 
That will work, as long as they have the essential edition licence, a virtual one will not carry across :)

 
Thanks amriddle01. So in a normal upgrade, without the hardware swap, is it the 500v2 that realizes an upgrade occurs and check for the license?
 
The chassis writes into it's flash the used version at the moment the first call is made. So with the first call the chassis is bound to that version as the newest you need no upgrade license for.
