Modem Toggling between active and stanby servers

Has anyone seen this before?
I have an two S8700 duplicated servers running CM 3.0 with the latest patches on them but when I dial into them the modems toggle between the active and standby instead of just answering on the active server. The modems firmware has been upgraded.
Any ideas?

Just wait and give the modem the time to disconnect. If you're dialing directly again after hanging up the modem of the active server will be still busy and the standby will answer.

We are not dialling the server immediately after it is quite a bit of time afterwards. So the active will have had time to go to stable
