hey guys,

not sure if this is an ethical sutiation or not, but here goes..

i've been working with a small IT Support firm in Glasgow for a few months now, it's been really quiet, and there ain't always a lot to do.

the other day i was offered a job in a bigger company with lots of ongoing projects to keep me busy - i seriously contemplated taking it.

i went to my boss & explained the situation, that it was easier to travel to [my mom could get her car back. i couldn't afford one on the wages i was getting] & after he asked many times i revealed that it was slightly better pay/hours.

that was the end of that conversation, bearing in mind that i still hadn't made my mind up yet. i was plainly hinting that i would like to stay if he was gonna offer a better contract, but he says he wasn't going to take anyone on at the moment.

this is my last week in my job and he has gone and advertised my position in the job centre for better wages/hours/conditions than what i am receiving just now.

is that crap or what?
i just need a rant

I would get out of there while you can - for whatever reason it appears as though he is determined to employ someone else, he certainly had the opportunity to improve your pay and conditions, but decided not to take it.

On first appearance it would seem that your future prospects would be best served by another company.

If it makes you feel any better, I have a friend who (about 3 months ago) was informed that his company was eliminating his position. However, they had created a new postion with the exact same job description and duties, but they had given it a new name and the pay was somewhat less than what he was currently making. In order to get the new position, he would have to put in an application for it just like anyone else in the company (or off the street). He put in his application, was not accepted, and was informed that he had to train the person that was accepted before his current position was eliminated and he was let go.

He had several "colorfull quotes" for his boss, which I will not repeat here...

Well I know what kind of training most people would give that poor new person. I believe this man has a legal case. I would consider talking to his State Labor Borad if he is inthe US. I'm not much for sueing, but I'd make an exception ina case like that.

Many companies do not match or make better offers to people who are leaving jobs because they figure they will be losing them again soon anyway. Even if the comanpany makes an offer, it is best not to accept it. They are aware you are looking and will probably be lining up your replacement. The fact that you got more money elsewhere may have also played into their decision to make the working conditions better for the next person. When I left my job a Lockheed, I got a 60% pay raise. As a direct result of this, they paid my replacement 10K more than I was making.
 
Im missing the bad part here. Here my understanding of the basics.

We have a contract worker who's contract is about the end. The worker goes to the boss and wants a better new contract. The boss doesnt take the bait. The boss advertises the position.

What's the legal case. Sounds like you took a gamble to me. The boss may or may not want to continue your contract, so he's getting someone to feel that spot. Nothing illegal or unethical there.

You let your left hand know what your right hand was doing, as the saying goes. You took a gamble that they'd want you so much, they'd renegotiate a new and better contract. Sometimes that works, sometimes it doesn't. I don't see how the company is under any obligation to extend, renew or negotiate a new contract with you. (So I dont know why SQLsister thinks you have a legal case.) (Is there a clause in your contract that says that?)

 
NO lunatic doesn't have a case, but the case Ecobb described would be a lagal case becasue they eliminated his position and then transferreed all the duties to a new position and immediately hired for it. That is a not legal in most states.
 
All they have to do is change one duty in the job description and its not the same job. Their safe. Seen down many times.

Can you post a link for the pleading for Ecobb?

If I were a boss and one of my employees came to me to explain he wanted to leave for another company - I wouldn't offer him any improvement either!
Your boss must be convinced that you're not interested in working for him anymore. So why should he offer you anything? No unfair action, the way I see it.

You're chances for better payment would've been greater, if you just had asked him for more money and kept the other job out of your talk. If he then refuses - so what? ;-)

I think i was more annoyed that my boss was rubbing my face in it, he did actually tell one interviewee over the phone [in front of me] that he would be receiving more pay than what the original post was offering. [while smiling smugly]

but to have a happy ending; the new jobs' doing great, still in training at the moment but there's gonna be a lot of projects to keep me busy throughout the year.

A programmer recently posted a similar issue, except he actually loved his job he was just paid lots (i think he said 40% under going rate) so I'll tell you the same thing........

Money ain't everything you spend 8 - or in IT 14 - hours a day in your job so as long as you've got a full belly and a roof over your head what more is there?

But congrat's certainly sounds like you have made the right decision.
 
yeah you're right money isn't everything but you can't pay bills with chocolate coins - the banks frown on that sort of behaivour [evil]

but i certainly have made the right decision... I would've regretted not doing so.
