Bad CPU? Bad Mobo??

( *NOTE: this post is related to my previous post:

My System was back to the Shop/Vendor again. ( Would not boot past Post, Windows Startup Mode Selection Screen, Windows Presentation Screen and the Stop Error listed above. )

1) I requested complete hardware diagnostics. They did none of this!
They said that they thought that the BIOS Settings are being lost;( but they did not replace the battery! )

2) I was told that one simple BIOS Setting was changed, and it booted right up>
?? ( why would a BIOS Setting Loss ONLY affect 'one simple BIOS Setting'? Date/Time were fine.)
Supposedly,it ran fine.

3)*( I don't know if it did boot up or not; and, I have not been able to get info on exactly what that 'one simple BIOS Setting' was.)

4) As soon as I got it back home, same problems again and won't Boot no matter what I have tried.
Shop/Vendor keeps emailing me different BIOS Settings to try; none of which work.

5) *( I have NOT seen any BIOS Setting change or loss following shutdown; tested after a few minutes, a few hours, 6 hours, 12 hours, and more than 24 hours. I don't believe that there has been a BIOS loss. )

6) CPU is now consistently overheating, and the CPU fan is inoperative; ( within 5 to 10 minutes it goes from 42C, to over 92C ( auto shutoff shortly after this temp ).

7) (*Note: This CPU has overheated previously with this GigaByte mobo after the Shop/Vendor removed it from the Intel mobo, and installed it on this mobo ( when I got it home; no mention of this from them. )
It also overheated previously on the Intel mobo. ( I have always been suspicious of a bad CPU; same CPU both mobos, and everything else was replaced. )
The overheating/lack of fan operation was always erratic; sometimes fan, sometimes not, sometimes overheating fast with fan operation, sometimes overheating after a relatively long time system running ( with fan operation ); and sometimes not overheating ( with fan operating ) at all during time period tested.

CPU/heatsink/fan, tabs, connections are all tight/seated.

???Is this a bad CPU for sure? Shop/Vendor keeps telling me that it is just fine.

Donot continue to run this with the overheating problem. Or risk permanent damage.

Is this under warranty??

Either, get a new HS fan, or heatsink+fan combo and install.

Fan has got to function to keep things cool.

Yes, I know the fan must be in operation to keep the CPU cool. The fan just started complete/or consistent inoperation this morning. This CPU and this mobo do automatic shutoffs when a certain temp is reached. (Evenso, during my BIOS Settings experimentation, I have been monitoring and turning off before it gets near the autoshutoff temp; once it began to do the autoshutoff just his morning.)
Full Warranty. Everything in this system is brand new and Retail ( in October ); and purchased from the same Vendor.

My stance on this is that the Vendor should be replacing this CPU ( rather than suggesting that I send it out to Intel myself; considering that I have never been able to use this system at all ( 1rst build (Intel mobo), OR the 2nd build ( this GigaByte mobo ). So far, they are telling me that 'if it boots to Post Screen, nothing is wrong with the CPU' ( which is pure crap.....)

Bring it back, and tell him you don't care why it doesn't boot, as long as he fixes it. Threaten to go to the Better Business Burueau, if they are available where you live. That usually lights a fire under shady vendors.

BOOT PROBLEM SOLVED!

1) Dying/then totally dead CPU fan: fan was replaced
2) Very specific BIOS Settings ( very touchy: one off; it won't boot ) Not real simple to figure out which ones are right; manual doesn't go into much with a non-RAID setup, and RAID-releated Settings are Default on this mobo.
( CPU fan was replaced; only one combo of BIOS Settings was identified and set. Booted perfectly at the shop; but would not Boot again after I got it home and connected the keyboard, mouse and monitor. )
I swapped and tested with 2 different keyboards and 3 different mice ( in every combination )/same monitor: No Boot.
Then, I swapped out the test monitor for my new Viewsonic FlatScreen: instant Boot!
( I also tested with keyboard only, mouse only; and all combinations of mice and keyboards. )
3) GA-81955X Royal is in CONFLICT WITH AN ORDINARY MONITOR!
( HP Pavilion Model: D3857A ) Nothing wrong with this monitor; works just fine with every other system we have tested it with!

I was attending a warranty call today with a similar problem. The customer had bought a 17” TFT monitor and the pc Hung on post. For some reason the monitor was feeding back to the computer.
As for the overheating problem, talk to the shop you got the computer from and tell them that because of the overheating and the time it took them to figure out a simple fault like the CPU fan, you wand them to fully test the CPU and you want to see the results. Any computer engineer worth his salts will know how to do this and will have no problem in doing it foe you.
