Very strange DFS Issue

I have a Data share replicated between 2 servers with 2 way replication. All users connect to server1 for data access and server2 is a failover if server1 is uncontactable.

we keep getting excel file conflicts originating from server2 however no data is updated on this server, i have even disabled the failover in the DFS name space.

when the conflict occures the file on server1 is moved to conflicted folder and the wining conflit file is never replicated over to server1.

this error is happerning every morning before users are even connected and its always the same 2 or 3 excel files

we are using windows 2003 server r2 with DFSR
