spot color black problem

I have created an Illustrator file (CS2 Mac) for import into In Design (CS2 Mac) with two colors black plus one pms to match my 2 spot colors in In Design. The problem occurs when the Illustrator file is imported into In Design. The black is a CMYK black creating a third color. Illustrator will not let you name black a spot color. I do not use Illustrator very much so I am at a loss as to how to make black export as a spot color. I’m sure it must be a simple solution.

Clip - If you go to Window | Swatch Libraries and select Pantone Solid Uncoated (or Coated depending on what you're looking for) there's a Pantone Black in the list - that will export as a spot color.
