I've looked over the net for a solution, but no avail

I have a backup of a sharepoint site I had before our server died. it is a .dat file.

I've tried to restore it on the new installation, but I'm getting an error saying that you can't restore as the versions are different. The current sharepoint is patched to SP1,and I think the previous version was when I took the backup

I've read MS article KB827701, but the 4 files it lists at the beginning are what I'm missing. I have an old server backup on tape, but the MSSQL Sharepoint database folder doesn't have the 'DATA' folder, just a 'Backup' and 'BINN' folder
 
It sounds like you made an stsadm.exe site collection backup, rather than a SQL database backup. The article in KB827701 refers to the latter.

stsadm.exe won't let you restore a backup that is *newer* than the current SharePoint version you have installed. For example, if you had SP2 installed when you backed up, and are now upgrading to SP1, you'd get this message.
