Does anyone have sample POS contracts for Micros and Aloha? I'm trying to learn more about what the restaurants rights are and what they can and can't do within their systems.

Sam,
Although your reseller might have the tone that dictates that they are in charge of your system therefore you MUST purchase their managed services plans the opposite is actually the reality. As the business owner you own your system, the computers, the software etc..Therefore legally you have control over what services, software upgrades, and hardware reinvestment's are purchased. Many resellers create programs that make it very difficult to choose when and how you reinvest in your technology but a little vigilance goes a long way.
For instance,take PCI compliance issues for example. If you spend thousands every year on all of the software upgrades, PCI consulting and every bell and whistle your reseller throws at you, if you are ever breached and your customer CC information is accessed illegally your reseller is going to tell you that ultimately it's on you as the business and that they are not responsible.
This can be really confusing stuff and I could go on for days about it but try to keep in mind that you are the owner of your system and therefore responsible for both it's security and maintenance regardless of what your reseller tells you. If you look at it from that perspective it should get easier to choose what services and products you need to invest in. I hope this helps.

Restaurants purchase the license to use the software, they do not actually purchase the software. Obviously, there are certain items that the resellers do not want you, the end user to know, but in the end you should be able to manipulate it to your heart's content. There are some resellers out there that do not want you to purchase different hardware from someone else, but that is really up to the reseller's office. There are good and bad resellers out there for Aloha and Micros and just ask around to other restaurant owners to get their opinions. Remember, POS offices, do not have a breakfast, lunch, dinner rush and do not have money coming in every day and need to acquire revenue in other ways. While they should not try to gouge you on every purchase, they should be fair and the restaurant needs to understand how the reseller makes its money and maintains its bottom line....
