lasso tool won't select similar.

i have been trying to remove the background of an image with the lasso tool, using select similar on a pure black background with no other black in the picture, it should select just the background.... or at least thats what it did before. it decided to start selecting the whole picture instead. how do i fix it if i didnt change anything to begin with?
 
Maybe the image originaly was a fireworks file, and it recognised that the main image and the background were seperate, and now it is a jpeg etc and can't distinguish.

The way I do this is to use the export wizard and choose gif, and hit the select transparancy button and select the black colour, and also then click any little bits of black left round the edge. I would then import this gif into a blank image, with a colour of background that I want (or just white). This works well on cartoon like images, if it is an actual photograph then it may not be as easy.
