LACP TRUNkING PROBLEM ON 5406ZL and 5308XL

I am having trouble getting lacp trunking active on all 4 ports between a 5406ZL and 5308XL procurve switches.

the 5406 has ports b1-b4 marked as lacp active

the 5308 have ports b1-b4 marked as lacp passive

I issue the cli command

trunk b1-b4 Trk3 LACP on both switches

my result after the links come up on both ends are that the ports on each side are marked as lacp active and only B! in the tunk group is up with lacp partner as yes and lacp status as success.

no matter what I have tried I can not get more than one port active in the lacp trunk group.

Need helpful thoughts here to get this running.

the commands on the 5308xl are below - note that the no lacp command gets put in automatically and I can't remove it
