Herbal website and legal matters?

I have been asked to do a website for weightlifting supplements, vitamins and herbal products. These products are all under a mother company that sells its products to retailers. Does this person need to see a lawyer before they have a website designed even if they have a disclaimer?? If anyone has any idea on this I would love to hear. This is in Canada if that makes a difference. Is there a site that has rules and regulations on what has to be done for these sites??

Hi Blue dragon,

There are a couple of sites that sell the product on the internet already. The products are not illegal to sell. They are being sold through home businesses. Here is another site that sells the products.

Is the site going to be selling these items to customers based outside Canada? If so, then foreign sales regulations for the countries in which they are to be sold as well as medical requirements need to be taken into consideration.

As long as its legal where you are selling them and the packages have the proper labeling required by law, I do not see any problems.

Then again, we live in a litigious society, who knows what can happen.

The reason I ask is that certainly in Germany, some supplements and vitamins are classified as medication and are only legally available there with a doctors prescription.

Then I would most definately add a disclaimer citing that for those products. And, you may want to confer with a lawyer on it as well. Better to be protected and sure of it then to listen to the rantings of this poster :)

You have to be careful about disclaimers as well: In the UK, they are not enforceable.
Putting a disclaimer on a product or site does not remove the provider of those goods or service's liabilities in UK law. There is no way that these can be removed.

That is why I suggest talking to a (I hate to say it) lawyer (especially if they specialize in that area). One can never be to careful to protect ones self... :)

Thank you both for all the feedback. I will make sure that we follow through with some advice from a lawyer. I'm assuming that since the site is on the internet my client will be selling to people in the United States as well as other countries.(US money is worth more than ours!) sad but true.
