excel not sorting first row correctly

does excel have a bug or am i overlooking something? I sort my data with a column header and sometimes excel overlooks the very first row of information below the column header in the sort.

However the selection or range definitely is correct.

any ideas? any suggestions is much appreciated.

In Data/Sort there is an option button - My List HAS or HAS NO header row.

To be sure, sort this way.

Have you got any formulas in other cells that are not part of your sort range, but do determine other cells within it. If so, expand your sort range to include these cells.
