Can't delete a file without Security tab

Hi,
I have a .txt file on a NTFS partition that doesn't have a Security tab
under properties so I can't delete that file. I receive access denied if I
try to open or delete the file.
I tried cacls to add ACLs to the file but still having Access denied.

How can I remove that file

Sounds like you need to take ownership. This is on 2003? Why is there no security tab?
 
I can't take ownership, there is no security tab. This file was created with a vbscript OpenTextFile method. There is other files in that folders with the tab but this problematic file don't! I don't know why. I red articles talking about special characters and namespace issues but I tried those solutions and they didn't work for me. I always have Access denied, from the cmd prompt or with the GUI.
I tried del \\.\c:\folder\file.txt, didn't work.
I downloaded software like killbox and Copylock with the same results.
I also tried deleting the file in Safe Mode.

I'm stuck! this file is causing trouble to my backup software.
