XP restore CD cannot find eula

I have an emchines M5405. I received a restore CD, but when I try to restore, it fails with the error message that it cannot find the eula. I can see eula.txt on the cd, so what is the setup program really complaining about?

Is the restore CD just putting an image back on machine or is it actually doing an XP install?

Have you talked emachines about the problem (would be my first port of call)?

I finally found someone at Emachines (now Gateway) who told me that the recovery CD I received was a Console recovery cd to be run from the command prompt I believe and they would be sending the correct one real soon.
We never did discuss the issue of whether the Console cd would actually work if I had known how to use it.
