URL ownership issue 1

I have a US client who are dissatisfied with the individual/company who is doing there website design and managing their updates. The client wants to use a different hosting service and designer. However they found that their domain name had been registered in the name of the previous web design service and not in their own name.

Anyone have any experience of such a situation?

I have come across this twice. Once, we simply asked that they transfer the domain to us. Because the bill was paid for work so far, no problem. Web designers and especially companies don't need extra domains (unless it's good :) )

On the second attempt though, for another, the work or hosting (not sure which) wasn't paid. We had to wait for the name to expire (again, the design company wasn't interested in the domain), then registered ourselves. We were lucky in the sense we only had to wait 8 months, not 5 years.

Just on a side note, i have experience a similar situation to this and there is one problem (might just be for .uk) but if someone leaves there domain and doesnt re-new, it becomes DETAGGED. And until NIK.co.uk get told by the owner to release it, or to re-tag it (costs a packet). Then it just gets left as DE-tagged and no-one can register it.
