Union Query Report Annoyance

Hi I hope someone can help me with this its really annoying me.

I'm using a union query as a reports source, when I open it from the database window its displays ok.

The problem is when I open it using code with a filter the report will not open at all. I really need this to work.

Does anyone have any ideas?
