Unable to create a "Bad" Acknowledgement w/ EC Gateway

Has anyone had this problem before? I am running HIPAA transactions thru EC Gateway & when the file fails compliance a bad 997 acknowledgement should be generated but it's not happening. Good transaction files build the 997 without any problem.

I'm stuck on this one.
