transactional replication issue

We have had some latency issues while recreating transactional replication for one of our databases. The db is rather large (around 300 gig) and due to the slowness we were experiencing it took 6 hours to create the snapshot (pull subscription). The next phase began (distribution agent) and there were some timeouts but, eventually it looked like it would complete. Then all of the sudden we got the message

The initial snapshot for publication'x' is not yet available. Since we just created the snapshot last night (finished at around 6:30 pm) Subscriptions are set to never expire.... Needless to say the number of undistibuted commands is not going down.

Any thoughts?

Further shows this looks like the bug that was fixed in cummulative update 12 so I guess I have to apply that and redo replication one more time.
