sysvol not replicating after dcpromo

I have a new dc within a 2k domain. I want to remove the old server from the domain and keep the new server (both 2k)
After dcpromo up the new server the sysvol did not replicate. (I didn't receive any errors)If the old server is offline the new server cannot see AD (since no sysvol)The AD is ok because once I bring the old server online AD is fine. I need to remove the old server from the domain. When I do this I get NO domain controller available when trying to access AD from new server
I have forced replication.
I have dcpromo down twice hoping the sysvol would appear(didn't)
help I don't want to reload I have 2400 users and 400 2k machines Any ideas please

You might have to transfer the fsmo roles to the new dc ....
