Slow connection speed

I have a external 3com US Robotics 56k faxmodem v.90. It only connects at 44,000bps (sometimes even less). But i had an old conexant winmodem and that managed to connect at 45,333bps, this old modem had an average download speed of 4.6 k/s. But my new 3com modem downloads at only 3.7 k/s. I have the latest drivers.
does anyone know how to improve the connection speed/improve the download speed.

I have the buffers on maximum and the maximum speed at 115200 bps (this is the same as the win.ini com1 setting). I do not have any other things plugged into my phone line.

have you asked your teleco to increase the gain on your phone line ?

I did, and my connection went from 40/42 to 53 every time !
