Problems with ML10?

Has anyone experienced problems attempting to apply ML10?

My system details are:
# oslevel -r
4330-09

# oslevel -r -q
Known Recommended Maintenance Levels
------------------------------------
4330-09
4330-08
4330-07
4330-06
4330-05
4330-04
4330-03
4330-02
4330-01
4320-02

I have downloaded the maintenace package to move from 4330-09 to 4330-10 and attempted to apply it only to get the following message:

"No filesets on the media could be used to update the currently installed software. Either the software is already at the same level as on the media, or the media contains only filesets which are not currently installed."

Is there a problem with ML10 or is the message correct?

Check out your VRMF of bos.rte.install - is it 4.3.3.80 or above ? I've seen ML10 not being reported as ML10 due to low bos.rte.install. Addressed by U482596 (1.8 MB).

Better still try:
instfix -ciqk 4330-10_AIX_ML | grep ":-:"

This SHOULD display the names of filesets "missing" that compliment the ML10 Maintenance Level.

The instfix command returns nothing however details of bos.rte.install are:
# lslpp -l bos.rte.install
