Problems defining brush

I have made some text, rasterized it and cut away at it a little bit to make it look a bit grungy and I want to make it a brush but when I try to "Define Brush" I get "Could not complete the Define Brush command because selected area is empty" ... When I add a layer with just a fill then it works, but I do not want this background in the brush, I just want the text... any thoughts?

nevermind - I had it as white - I inverted it and it worked fine....
