Packet Capture shows many [TCP out-of-order] packets

Like 1 per every packet sent!!

Is this common on a Cisco Catalyst 6000 switch.
I do not have any redundant paths, or loops.
I have Spanning tree on anyway to protect from looping

My Switch has never seemed like it was running at full speed, can this be part of the problem?

 
How are you performing the capture?
Are you monitoring a port or vlan?
If it is a port, is it a trunked port?
Are you capturing both tx and rx?
