Ok should I upgrade or buy this instead.

As far as I can tell this is legit? I just want your opinions, I have FileMaker 5 and I'm due for a upgrade. I can get FIleMaker Pro 7 for $49 according to this deal site article or I can pay Filemaker $100 more for the upgrade, is there any reason why I shouldn't just buy the one off the deal site?
 
The FM 7 version on the deal site is an OEM version.

To be on the safe side, stay away from OEM versions.
OEM versions come always with restrictions.
Sometimes, people and/or companies will not use the OEM software that came with their computer, and so they decide to sell the software, usually very inexpensively.
There ARE restrictions, however. Some OEM software comes with a restrictive license that says it can only be used with the hardware it originally came with.

You may have trouble if you want to update/upgrade your software if there is no 'match key'.
You should always find out the license restrictions with OEM software BEFORE you buy.
