Not allowed to over depreciate asset

I have a multi-company setup (starting Ledger for Italy which is the company in question, states that the depreciation value must be same for each month) changing from 12 to 13 periods for this fiscal year(year-end date change). In Fixed Assets I have issue where we have a depreciation rule setup to have year 1 -3 one formula and year 4 onwards a different formula. Depreciation is okay until running depreciation for period 1 of the new fiscal year 06 (Fiscal year 06 has 12 periods) - receive error message not allowed to over depreciate asset.

What is the best way to run depreciation for the first period, and to have the depreciation for each month?
