New modem connects at same speed as old but downloads slower

I have a 3com US Robotics 56k fax modem with the latest drivers installed (external and not a winmodem). This connects at 44k/s
I used to have a conexant soft 56k winmodem,this used to connect at 45k/s before it broke.
The conexant modem used to download at 4.5 - 4.7 k/s but the 3com modem only downloads at 3.5k/s ( i have done many tests to find the maximum constant download speed)
Is there any way to make my new modem download faster?
