New import goes to background layer

When I try to import a photo to a new layer it puts it in the background layer. Was doing ok but then suddenly this happens!!!! Can anybody help me please.

'Import' or paste? Is your image colour mode RGB?

Moe: It could have been a real ugly situation, but luckily I managed to shoot him in the spine.

Don't import it. Open the image by itself, and drag it into the desired picture. It will be on a layer just above the one which was active.
