Move smart jack

Hello gentlemen,

I've got a customer with a BCM50 who is using Time Warner Telecom for their internet and pri. The customer is moving to a different suite in the same building and has forgotten to contact Time Warner about moving their Adtran until the last minute. AT&T is delivering the T1 for Time Warner via a smartjack on the wall next to Time Warner's Adtran.
Problem: The customer states that Time Warner has approved the vendor (my company) to move Time Warner's Adtran and AT&T's smartjack to the new suite. I told the customer no, if TW Telecom and AT&T don't move their own equipment, it doesn't get moved.
Simply installing an extension is out of the question because the wall the smartjack is mounted on is scheduled to be demolished.
Never in my 33 years of telephone work have I heard of a telephone vendor relocating the telephone company's equipment legally. What I have heard is that AT&T is within their legal right to file a tariff violation with the FCC to sue anyone who does this.
Any input?
 
don't touch it..... can you do it yes. Should you HELL no. Telco is telco, I might move a dmarc on the same board ..........maybe........if no one notices.......but not.....never........ever ......to a new suite........ever.
 
We do it all the time. Dmarc is typically the common phone closet of the building/floor and then the rest is inside cable to the suite. Lec/Clec doesn't care. Move it and have customer call business office to report change of suite number. The only thing we won't move is fiber, not equipped to repair if something goes wrong.

I would move it or you could be waiting a long time for AT&T to show up. IF they show up! You are still in the same building and just moving via house cable etc, no problem.

It's a phone system, NOT a clock!
 
If there is a concern in the USA then have them sign some sort of waiver and relocate it.

Also have the client get something in writing from the carrier if they want you to move it.

I say if no sign on the equipment then too bad, I have also been relocating pair gains etc.

I contacted a Time Warner CSR that I know about this matter and he told me Time Warner could authorize me to move their Adtran but Time Warner could not authorize me to move AT&T's smart jack. He also stated that AT&T never allows any outside party to move AT&T equipment.
I spoke with an AT&T technician who has been with BellSouth/AT&T for many years while working on a cut yesterday. He stated that yes, in our Southeast U.S. region AT&T can file suit against any vendor or outside party who relocates a smart jack, even within the same office space but it's rarely enforced. It would require an AT&T technician to turn in a report that's forwarded to an AT&T network inspector who decides to pursue legal action. Usually when outside wiring is involved. Whether this AT&T guy's word is accurate or not is up in the air.
Looks like things are going to be okay for the customer though. My outfit's decided to err on the side of caution so we're going to run an extension, relocate Time Warner's Adtran and the customer will wait on AT&T to come out and move their smart jack (about 30 days). The wall will be demolished after AT&T is done.
Apparently there's a considerable amount of variation between Canadian and American regulations and practices.
A question for Marv and Curly - In Canada are you also allowed to move the telco's equipment to a different address?

Only within a building to a different suite, customer then contacts telco to inform of different suite/floor.

my reply was from my experience in the southern US, should have clarified that. And while it does take a lot to attract bad legal attention to this, if you get the wrong tech on a day that hes not in a good mood then yes I've seen it happen.
