Mitel Licences - Legality Regarding Second User Sales 3

Hello there,

Does anyone know the legal status of Mitel licences when the system has been decommissioned and passed into the second user market?

The reason I'd like to know, we tend to get old system bundles in e.g. a system and an amount of phones, the phones have always sold well and the systems just sit in the stock room, when selling these are we allowed to advertise them as having X licences on? Do we need to have some kind of disclaimer stating we don't own the rights to the licences?

I know this isn't really system related in a technical manner, but if someone, somewhere will know - it'll be here.

I think this is the way it is ..........

The I button inside a controller is linked to a customer account that is held by a Mitel reseller in a license bank called the AMC.

The licenses are Non transferable between end users .

if an old system is resold , the hardware can be reused , but

if a new customer wants to 'own ' some licenses they need their own account created and they need to purchase a license pack.

A buyer of a second hand system will probably be able to reset the password , but if the current license has no valid software assurance on it ,
they will not be able to upgrade it past its current level.

Eg if you buy a controller and it have ver 7 software and no software assurance , you can load all patches for ver 7 , but cant take it to 8 or above without software assurance.
You cant buy software assurance unless you own the license .

if you do a full reload of the software ( wiping the current license code(ARID) and you dont know the ARID then you wont be able to use the controller at all.

Licenses are just that. The license is only intended to be used by the initial purchaser and has no right of sale or transfer. The hardware can be sold but the new user must license the system to what ever specs they require. Licenses can only be acquired through a Mitel authorized dealer. Generally, Mitel will require that a new system id be purchased.

NO GOOD DEED GOES UNPUNISHED!
 
As nytalkin said, you will need a new iButton (STSID) and new basic software, IP phone licenses, mailbox licenses, etc to make the system(s) legal. Also a Mitel dealer to sell and support further licensing of controller.
 
So "yes" you need a disclaimer that you don't have ownership of the licenses so they are not transferable and "no" you can't advertise them as having licenses. One thing to be aware of is the older LX and Mx models are not upgradable to the latest software so anyone buying them and attempting to put them into service will be stuck at older non-supported software. This, I would think would make them less attractive. That is most likely why you have no trouble reselling sets but may not be able to sell the controllers.
