LEC Verbal Agreements 1

I am working with a company with over 500 locations. Each site was independent for Telecom and Data. Now they have a large contract for new service. I have no "foot hold" on the number of lines at each site and contracts, written or verbal.

What is the legal writing on these verbal agreements? Has anyone contested these before?

I've contested quite a few situaions and pricing issues that were rooted in the past, around ex-employees. One was a 25 cent/minute rate for dedicated usage billed by a carrier (with a name made of 3 letters not not MCI:

They clamined nobody signed a newer contract.

I produced email messages that were as informal as you can get, but the real point, if it went to court, was "how could you let a customer as significant as we were, continue to pat 25 cents per minute" "Even if the customer contact failed to act, it was your dutuie to inform higher managements senior manafement

4 months later, I recieved the check for 280,000 that I argued was a resonable refund. And this was without any outside consultants or lawyers

The moral of the story is the contract is almost never an issue needing escalation beyond a lowlt sales rep. If it is a bad rate, they will change it without any fight.
