Is my ASA bandwidth throttling?

I have an ASA 5510 which I have really no problems with, it is a great firewall. I also have an appliance for email security, a spam filter. The spam filter is supposed to be able to update a set of small databases every so often. The problem is that some of the thumbprint databases stop in the middle of the download, and it never completes. Now, sometimes I can manually run the command to fetch the db. Sometimes the connection times out. The vendor insists that my ASA must be throttling port 80, but I dont have any QOS enabled, and I have specific access-list for the spam filter to allow tcp eq 80. Is there anywhere else the throttling could be happening? or any other theories. I've already talked to the isp, and they are not throttling our circuit.
