InCopy: Updating Design locks out user

When a file is being edited in InCopy, a user will often notice that the "Update Design" icon appears. Once the file is updated the user no longer has the ability to check a story back in or out. However the rollover/pop up box claims that the file is checked out by that same user. The only way to work around this is open the file in InDesign, unlink the file, delete the stories from their folder, and then recreate new stories with a slightly different name.

Anyone have any suggestions about what might be causing this? Our editors often work in files when someone isn't present to recreate stories for them so their workflow is impeded.
