Including linked files when saving eps files

Have noticed something with Illustrator CS2 that is a problem with out workflow. We use various scripts to place images in illustrator documents. When the scripts place these items they are linked and we do not want that. Our solution up until CS2 has been to have the scripts save the illustrator files as eps files with linked files embedded. Everything was great up until CS2, now when we save the files with include linked files the images all end up with clipping paths on them. This is a pretty serious problem that has caused us to go back to CS. It's not something with the script or the images as you can take a blank document and place (link) any image and then save it with include linked images and the result will be the same. (An image with a clipping path around it). Is this something anyone else has noticed and is there a workaround without trying to mod our script to try and embed the files before saving, which doesn't seem as though it will work anyway)
