There was a thread about a month or so ago, and it was about FixDBF. Someone wanted to know about DBF corruption. So, I told him about dSalvage, and I had a copy, and I told him where he can get it form, and I said, if you need to try, i will send you a copy.


So, about a month later, I get a call from the Makers of dSalvage, and they want me to pay $200. Though, I understand that they want their money, but, it sux, cuz, it was for trial... I guess, the law is the law, and I have to mail them a check for $200, for something I haven't used in 6 years....

So, I hope you guys don't do what I did.... I understand, I don't want people copying my stuff too...

But, how the heck they found out? was it a set-up? Trust me I didn't give the dSalvage, It was for whomever the person was to try it out... but, I guess that guy worked for dSalvage..

Anyway, I am gonna pay the $200, why not? right? it is their rights!!

The advice here is always free, but be careful about requests for software.

I have always been leary about people asking to be sent one software piece or another. I am never sure what is considered public domain and thus can be shared. So the policy I would always follow is to just direct the request to the company's themselves and have the person download any demos or purchase it directly.
 
yea, I learned the hard way... I swear my intention is for the guy to try it, and then he can purchase it. I mean the product is realy realy old. It is like giving someone windows 3.1 diskettes. But, I have to pay for it.. Please let me know if this helped you :)

Since you are not using this package, don't you have the
right to sell it or give it away ?,

I follow your thinking - but can you confirm, they are billing YOU because a) they have your address and b) because you have had a piece of software lying around for years on old floppy discs that you might, or might not, have a licence for?

It does seem a bit opportunistic, and hardly endears them to others - have you tried calling them to negotiate? Has to be worth at least one shot.


Nice people from dSalvage, if you are listening (alright reading) this - please let Tekno off, or at least give him a discount.

I think if you are not satisfied with it you shouldn't
pay anything. If we let others to charge such amount of
money for a bad program (which others give
for free) they will want to charge for the air next time.
Figure out they tell you that you own them $2000 or so.
If you didn't sign anything, don't pay for anything !

I do sympathise somewhat, but you have to look at who looks at these forums? The people interested in the subject. This includes vendors as well as programmers. As such, wouldn’t we, as programmers, be a little upset if people gave our intellectual property away? These are public forums and it's unwise to dodgey things in public.

Hi All:
First of all, none of us are lawyers so any legal advice would be worth zilch. That being said, I asked a lawyer from my company his opinion of all this:

1) If you had a 60 day trial copy 6 years ago and you still actively use it: you owe the license fee for the production copy (that could include having it installed even if you don't use it).

2) If you still have the software (on disk) but don't use it, But you have a really good memory (since you remembered what the software does and where to get it) then it is up to the company who sent you the bill to prove breach of contract.

Think about it, if I read a review of software, remembered its functionality, recommended it.. they cannot send me a bill.

HOWEVER, you offered to send them 'a copy' and if they like it, buy it.. Note, Not YOUR copy, (which probably transferrable) but a copy of your copy. THIS could be an act of 'bad faith' (although I think you were within the realm of good faith). Did you send him the copy ?

BOTTOM LINE: If YOU are using the s/w, pay the fee.
If you sent him the s/w and he is using it.. HE pays the fee.. (and don't do that anymore)
Other than that, don't pay the fee... If we had to pay a fee everytime we remembered a good package and recommended it.. Perish the thought !
