Hayes 56k modem too slow

I just bought a Hayes 5362US 56K external modem. It won't connect at 56K. It usually connects at 24k. My old USR 33k modem always connects at 28.8. The Hayes connected once at 44k. I have tried setting the speed at various settings. I have downloaded the V.90 flash update. It doesn't help.

Is this thing buggy or what?

I have the same problem with my 56 k modem. I called the phone company once and they told me that it can be due to interference on the phone line. This can increase when a lot of people in the neigberhood are making phone calls through the same connection points as you are on. It can also be caused by bad phone lines that are damaged.
