I am trying to write a report which will only display cases that have the identical statute_cd.

For example:
Case1 Statute_code1 - 28-701A
Statute_code2 - 28-7111
Statute_code3 - 28-701A

Case2 Statute_code1 - 28-745

Case3 Statute_code1 - 28-732
Statute_code3 - 13-311A

The only Case that should appear Case 1 - with Charge 1 and Charge 3 that are identical.

Group on case and then go to report->selection formula->GROUP and enter:

Distinctcount({table.statute_code},{table.case}) < count({table.statute_code},{table.case})

lbass' suggestion is the only way to do this. However, be aware that it causes all of the data that meets other selection criteria to be pulled into memory and filtered there for the group selection formula. If your report is pulling a lot of data, this can cause significant slowness in processing it.
