Custom colors on chart - legend not working

SSRS 2005 Oracle 10.0 db
We have a report that is showing a bar chart that we added custom colors to.
It has a category and series group, and when the first bar on the X axis does not have data for all the series, that color for that value does not show in the legend. The label shows in the legend, but the color does not. Does anyone know a workaround for this?
If not, would this be corrected in SSRS 2008?
