CheckOut of wrong version

User one checks out a file, makes changes and checks the file back in. User two checks out the same file, but a previous version is put into user two's working folder. Who did what wrong here? The user or the program?

The file was not shared and then branched. I tried unsuccessfully to reproduce the error by trying to check in a file without checking it out first.
