cgi-bin connection web page

hi everybody, i have a script that runs the wvdial command, so a user can connect or disconnect the server to internet from a web page, but i have one problem, when i submit the form that executes the wvdial command i get this error: Cannot open /dev/ttyS0 device or resource busy.
the modem is not busy, and the ttyS0 has apache ownership and groups permissions,, so i don't know what to do?
does anybody know?
