Cable Provider Tracking Program

Was told by a cable internet install tech that Excite@Home loads a tracking program on subscribers machines called "Tioga" and that they try to install it on the BIOS. I, in fact, found such a program loaded on my machine and it gets initiated at start-up. The data file did in fact change every time I accessed the internet. The tech support people say they have been told it is a program to "improve internet access" and have no knowledge if it is a tracking program. Anybody know anything about this?
 
I've never heard of it but I did a search on "tioga" at cnet.com and found some people with similar experiences. Everything points to this being a true utility for repairing damaged files and not for monitoring anything. It seems that several people indicated they had disabled it and one mentioned that the cable company wasn't even running the server on their end to collect the data from it. It appears that you could safely delete if you want.
