A potentially worrisome situation, but that article contains very few facts, lots of conjecture, and more questions which only serve to increase Fear, Uncertainty, and Doubt.

It is an op-ed fully of hypotheticals and very few facts.

I agree there's a lot of conjecture, but I do find the scenario plausible. I guess I prefer some proactive conjecture to the blind "Oh, that could never happen" attitude some acquaintances of mine have expressed. That could just be me also. I do tend to be an envision and prepare for the worst case scenario kind on person.

Cynical in the extreme I am. ;-)

This was discussed on slashdot. It's kind of a mixed bag -- the hosting company in question was notorious for hosting sites for script-kiddies and other no-good-niks. So everyone is glad they're shut down.

But at the same time, there's the element of "what if it happened to my ISP?"

Exactly, this is not a "Run screaming for the hills" thing, but it's yet another thing people should be thinking about. There's more danger to some of these things than simply getting an infected PC. There are myriad dangers out there and I think people need to be more aware of them.

Company breaks the law, their computers get seized and data analysed to determine the extend of their crimes and present a case to court.

That's perfectly normal.

Just because you're online doesn't mean you're no longer subject to the law (like the author seems to want to be)!
 
Who's trying to be immune from the law? The scenario is someone getting slammed by someone else.

Well yes and no. You might have your machine confiscated because someone used your machine as a zombie or similar, but at the end of the day if they cannot prove whether the machine was a willing party or not a conviction is not very likely.

I personally do not see any real issue with that.
 
I agree with MasterRacker here. Although this does not happen everyday, the scenario is very real. What swayed me is the addition of the Patriot Act in the lot.

Before this Act, I wouldn't worry about these raids. Under this Act, one is presumed guilty (my interpretation).

I would try not to visit questionable sites nowadays. The consequences could take years to clear: the Patriot Act allows that.
