BCM50 Packet Loss and Jitter Violation Errors

Running a BCM50 Ver. 3.0 with some 1120e and 1140e IP tel. sets at a remote location. The BCM is reporting the following errors:

Inter Arrival Jitter Violation Warning: 37ms, nearDN: 222, source IP: 10.10.15.253, source port: 51004, destination IP: 10.10.16.118, destination port: 28056, ct 0, eT D, nLR 109, dR 31, bD 156, bL 76025, gD 125, gL 84505, eSD 69, aNL 0, aSP 0, rTT 0

Packet Loss Violation Cleared: 1%, nearDN: 222, source IP: 10.10.15.253, source port: 51004, destination IP: 10.10.16.118, destination port: 28052, ct 0, eT D, nLR 380, dR 15, bD 585, bL 10900, gD 585, gL 5250, eSD 40, aNL 0, aSP 0, rTT 0


Customer has VPN set up, Port 7000 is open. Sets work but customer is complaining about QOS.
 
I definitely think the QOS is not properly enabled as other areas have been tested and excluded. Here are some questions I have relating to QOS:

Is it setup by default?
What priorities are enabled?
what are the implications of running this with qos over a network where it is not being used?

Any other info. about BCM50 QOS would be appreciated.
