ATI issues on a DELL

I am having some problems on a DELL inspiron 9400 series laptop running an ATI X1400 video card. The problem only occurs in games and that leads me to believe there are some conflicts between what the card wants to do and what the games want to do. The error can be slight (game crashes) to violet (blue screen of death). The game crash does not specify a video issue but by the error the game spits out it seems likely. The blue screen of death specifies what it beleives to be a driver issue and lists an ATIg.dll error. Sorry I forgot my note on the exact error i'll edit this later.
I checked the Dell site and the driver I have installed is the newest they support and I can't get beta drivers from the ATI site due to licensing or some such nonsense.

1. I think newer drivers would help
2. How do I go about installing them in this case?
3. Am I out in left field and looking in the wrong place?

any help is appreciated.
 
The latest non-beta drivers from the ATI site should work. You don't necessarily need the Dell-authorised ones.
