Arcserve error e3005

I received this error:

e3005 failed to access bindery file sys:\system\net$obj.sys
e3005 failed to access bindery file sys:\system\net$prop.sys
e3005 failed to access bindery file sys:\system\net$val.sys

we are running a 3.12 novel server and get the error when it tries to back up a directory to a 5.0 novel server.

any suggestions?
