apache and openssl with graceful restarts

I have a new solaris 10 server and I compiled openssl (0.9e) and apache (2.2.3) 64 bit. When I uncomment the line in apache to include the ssl.conf and do a graceful restart of httpd, the existing processes that are supposed to be gracefully shut down never change from the (G) status on the server-status screen. If I do it again, again the existing processes stay "G" (for gracefully shutting dow), and the new ones just have their -. When I uncomment that line in the conf file, I can gracefully restart numerous times and these just show as dash lines on the server-status screen.

Does anyone know how to fix this?



 
I have a typo in that, what I meant is WHEN I COMMENT-OUT THE INCLUDE LINE FOR SSL.CONF, I can gracefully restart as many times as I want and each new process just shows a - (not a G). Its almost like it is stuck in Gracefull restart.
