So what does everyone think of the proposed definition?

I'm actually frightened of this. The definition seems to fit well, but I fear that it isn't expansive enough. What happens once we've got a definition and a hole is found? This makes regulating spyware much more difficult.

What I'd rather see is companies be prosecuted for unfair business practices/shady business practices/lieing to consumers, etc... vs a definition of spyware.

There have been a few articles out that seem to be saying similar things to myself as well.
